
Notice is hereby given that the Board of Zoning Appeals of the Town of Smithfield, Virginia, will hold a public hearing at the continued meeting of the Board of Zoning Appeals in the council chambers in The Smithfield Center, 220 N. Church Street, meeting room A, Smithfield, Virginia on Tuesday, March 22nd, 2022, at 6:30 p.m. to consider the application of Marvin Smith, applicant, for an special yard exception under the provisions of Article 12, Section D. of the Zoning Ordinance of the Town of Smithfield, Virginia, adopted September 1, 1998, and as amended thereafter, in order to approve a special yard exception to allow a single family residential structure with a side yard setback of six inches. The applicants propose to construct a single-family dwelling house which will not meet the current ordinance requirements. The proposed structure will encroach into the side yard 10 feet +/-. The property is located at Lot 182A Riverview Avenue. The minimum side yard setback is 10 feet, as provided by the Zoning Ordinance. The subject property is zoned DN-R Downtown Neighborhood Residential District and EC Environmental Conservation District.
Any person affected by or interested in the aforesaid application may appear at the hearing and be heard. Copies of the Zoning Ordinance of the Town of Smithfield and application for this special yard exception are available for inspection in the Community Development and Planning Department, 310 Institute Street, Smithfield, Virginia 23430.
