PLANNING COMMISSION OF THE TOWN OF SMITHFIELD

AMENDMENT & REVISION OF COMPREHENSIVE PLAN

            Notice is hereby given that the Planning Commission of the Town of Smithfield, Virginia will hold a public hearing at the regular meeting of the Planning Commission at the Smithfield Center, 220 N Church St, Smithfield, VA 23430, on Tuesday, May 9th, 2023 at 6:30 PM to consider the application of Melissa Venable, applicant on behalf of LSMP LLC, owner, for a comprehensive plan amendment application.

The property which is the subject of this comprehensive plan amendment application is located at 502 Grace St & 518 Main St (TPINs 21A-04-000H2, 21A-04-000H4, 21A-04-000G1, 21A-04-000F, 21A-04-000E, 21A-04-030, 21A-04-000I12A, 21A-04-000I17, 21A-04-012, 21A-04-049, 21A-04-037, 21A-04-050, 21A-04-038, 21A-04-051, 21A-04-039, 21A-04-052, 21A-04-040, 21A-04-053, 21A-04-054, & 21A-04-000I15).  Specifically, this application is requested to alter the comprehensive plan’s Future Land Use Map (FLUM) so that the “Historic District Residential”-designated portion of this property (TPIN21A-04-012) is re-designated as “future Commercial Mixed Use” and the “Historic District / Mixed Use”-designated portions of this property (TPINs 21A-04-049, 21A-04-037, 21A-04-050, 21A-038, 21A-04-51, 21A-04-039, 21A-04-052, 21A-04-040, 21A-04-053, and 21A-04-054) are re-designated as “future Commercial Mixed Use.” The intent of this application is to accommodate an accompanying conditional official zoning map amendment (rezoning) application.

            Notice is hereby given that the Planning Commission of the Town of Smithfield, Virginia will hold a public hearing at the regular meeting of the Planning Commission at the Smithfield Center, 220 N Church St, Smithfield, VA 23430, on Tuesday, May 9th, 2023 at 6:30 PM to consider the application of Melissa Venable, applicant on behalf of LSMP LLC, owner, for an official zoning map amendment (conditional rezoning) application.

The property which is the subject of this conditional rezoning application is located at 502 Grace St & 518 Main St (TPINs 21A-04-000H2, 21A-04-000H4, 21A-04-000G1, 21A-04-000F, 21A-04-000E, 21A-04-030, 21A-04-000I12A, 21A-04-000I17, 21A-04-012, 21A-04-049, 21A-04-037, 21A-04-050, 21A-04-038, 21A-04-051, 21A-04-039, 21A-04-052, 21A-04-040, 21A-04-053, 21A-04-054, & 21A-04-000I15).  Specifically, this application is requested to rezone the “Downtown Neighborhood Residential,” “Downtown,” and “Community Conservation”-zoned portions of this property to “Planned Mixed Use Development.”  The intent of this application is to accommodate the applicant’s desired uses listed in Smithfield Zoning Ordinance Sections 3.J2.B.1, 3.J2.B.2, 3.J2.B.3, 3.J2.B.4, 3.J2.B.6, & 3.J2.B.16.  These uses are necessary to facilitate the construction of commercial structures and 304 dwelling units, in the form of single-family attached (“duplexes”) and detached homes, apartments, and an assortment of community facilities (parks, clubhouses, swimming pools, etc.).

SPECIAL USE PERMIT

            Notice is hereby given that the Planning Commission of the Town of Smithfield, Virginia will hold a public hearing at the regular meeting of the Planning Commission at the Smithfield Center, 220 N Church St, Smithfield, VA 23430, on Tuesday, May 9th, 2023 at 6:30 PM to consider the application of Melissa Venable, applicant on behalf of LSMP LLC, owner, for a Special Use Permit (SUP) application under the provisions of  Article 3.J2.C.18, of the Zoning Ordinance of the Town of Smithfield, Virginia, adopted Tuesday, September 1st, 1998, and as amended thereafter, requesting a waiver of parking and loading, for relief from Article 8.E.29, which requires a minimum of two (2) parking spaces per dwelling unit plus one (1) visitor space per every three (3) units for multifamily dwellings. The applicant is providing two parking spaces per unit for the multifamily dwellings (424 spaces) instead of the required 495 spaces. Additional relief from Article 8.B.4, which requires off-street parking to be located on the same lot, is requested, as the applicants are proposing a shared parking agreement for the development, including off-street parking. Finally, the applicant is seeking relief from Article 8.B.17. and Article 8.F.1.e. to allow off-street loading spaces to also count towards required parking spaces.

SPECIAL USE PERMIT

            Notice is hereby given that the Planning Commission of the Town of Smithfield, Virginia will hold a public hearing at the regular meeting of the Planning Commission at the Smithfield Center, 220 N Church St, Smithfield, VA 23430, on Tuesday, May 9th, 2023 at 6:30 PM to consider the application of Melissa Venable, applicant on behalf of LSMP LLC, owner, for a Special Use Permit (SUP) application under the provisions of  Article 3.J2.C.20, of the Zoning Ordinance of the Town of Smithfield, Virginia, adopted Tuesday, September 1st, 1998, and as amended thereafter, for a waiver of yard requirements. Specifically, the applicants are seeking a reduction of forty feet (40’) for the commercial front yard setback and a reduction of ten feet (10’) for the commercial side yard setback, allowing a zero-foot front yard setback and a ten-foot side yard setback for the commercial structures. An additional reduction of twenty-one feet (21’) for the residential front yard setback; a reduction of five feet (5’) for the residential side yard setback; and a reduction of ten-feet (10’) for the residential rear yard setback is requested, allowing a fourteen-foot front yard, ten-foot side yard, and twenty-five-foot rear yard for residential structures. A third reduction in the front yard of twenty-five feet (25’) is requested for the multifamily dwellings, allowing for a front yard setback of ten feet (10’). A final request is for relief from Article 3.J2.I.11 which requires a minimum setback of fifty-feet (50’) from contiguous residential properties, and instead providing a ten-foot side yard setback.
