
Notice is hereby given that the Board of Zoning Appeals of the Town of Smithfield, Virginia, will hold a public hearing at the continued meeting of the Board of Zoning Appeals in the council chambers in The Smithfield Center, 220 N. Church Street, meeting room A, Smithfield, Virginia on Tuesday, May 24th, 2022, at 6:30 p.m. to consider the application of Mark & Nicole Rutter, formerly F. Maynard Gwaltney, C/O T. Carter Williams, applicant, for an special use exception under the provisions of Article 12, Section F. of the Zoning Ordinance of the Town of Smithfield, Virginia, adopted September 1, 1998, and as amended thereafter, in order to approve a special use exception for an exception in the yard regulation on a lot where on the adjacent lot there is a similar front yard that does not conform with such yard regulations in a way similar to the exception applied for, in accordance with Article 12.F.7.a. The applicant proposes to construct a thirty foot (30’) by thirty foot (30’), 900 square footage garage, replacing the existing shed, located within a front yard. The property is located at 261 River Oaks Lane, Tax Map 22-02-02. The subject property is zoned C-C Community Conservation District and Environmental Conservation (EC) District.
Any person affected by or interested in the aforesaid application may appear at the hearing and be heard. Copies of the Zoning Ordinance of the Town of Smithfield and application for this special use exception are available for inspection in the Community Development and Planning Department, 310 Institute Street, Smithfield, Virginia 23430.
